The limitation is a mixed question of fact and law. Facts need to be proved in accordance with the evidence act. Once facts are not established a suit straightway on the ground of limitation cannot be dismissed. However, the question of limitation can be made a preliminary issue and a decision can be rendered on this issue alone.
